Criminal Charges in Cobb County State Court

The Cobb County State Court in Marietta, Georgia is located at 12 E. Park Square, Marietta, GA 30090. The Cobb County State Court handles misdemeanor criminal charges including traffic violations as well as select civil cases. Common criminal charges that begin in the Cobb County State Court include all traffic violations written by Cobb County Police Officers including DUI charges, shoplifting and marijuana charges written by Cobb County Police Officers, and all other misdemeanor offenses such as battery - family violence, disorderly conduct, and other non-shoplifting misdemeanor theft charges that occur in all municipalities within Cobb County.

There are six municipalities within Cobb County. Acworth, Austell, Kennesaw, Marietta, Powder Springs, and Smyrna all have their own municipal court system which is the court of initial jurisdiction for all traffic offenses including DUIs along with misdemeanor marijuana and shoplifting offenses written by each municipality’s police department. If the citation was written by Cobb County PD and not the individual municipality, it is likely that it will begin in Cobb County State Court.

There are 13 judges in the Cobb County State Court. The judges on the first and second floors handle predominantly traffic violations including DUI charges. The judges on the third and fourth floor handle primarily other misdemeanor offenses along with DUIs that request a jury trial from one of the county’s municipalities. Charges in the Cobb County State Court are prosecuted by the Cobb County Solicitor’s Office. The Solicitor’s office usually has two solicitor’s in each courtroom handling cases every day. Their caseload is managed by first letter of people’s last names and is usually split A-K and L-Z. The Cobb County Solicitor’s Office offers a diversion program for certain offenses upon first lifetime arrest. These charges include misdemeanor marijuana, theft by shoplifting, and minor in possession of alcohol. You need to have a retained or appointed attorney to enter the diversion program.
