What Type of Information Can I Provide in a Free Consultation
I get a lot of calls from potential clients asking me to tell them what is going to happen with their traffic citation or criminal charge. If i tell you what happened can you tell me if I’m guilty? Is it going to be dismissed? Can it be reduced? Will it be on my record? And I understand these questions are the biggest concern for people facing criminal charges. In Georgia, even traffic tickets are considered criminal offenses that can be (although most of the time are not) punishable by jail time and probation.
So it hurts every time I have to tell a client I can’t give specific advice regarding their situation. I wish I could give specific advice about every person’s case who calls me. But I often don’t know what the specific charges are. I don’t have all of the evidence. I haven’t evaluated how the specific facts and evidence of the case are applied to the law of the statute that is the subject of the accusation or indictment. And finally, as much as I’d like to be the Judge or jury who is ultimately going to decide innocence or guilt, I can only advocate and argue on behalf of those I represent. That ultimate decision is for the Judge or jury.
What I do when potential clients ask these questions is I usually try and tell people what their rights are. I tell potential clients what my experience for similar types of cases I’ve handled. I can usually, but not always tell people if they will be facing jail time, if their drivers license will be suspended, and what type of overall punishment they could
Be facing. And I try to answer questions to the best of my ability because I know that this charge is often the most important thing a potential client of mine is facing at the time.
