No Auto Insurance Can Lead to Suspended Tags and Serious Georgia License Consequences
I get a lot of calls from potential clients regarding citations for violations of Georgia Code 40-6-10 which is the code section for failure to maintain insurance under Georgia law. If you are cited for not having valid insurance at the time you are stopped by a police officer, you face a potential minimum 60 day suspension of your drivers license if convicted. If your license is suspended for no insurance, you are not eligible for a limited driving permit. You are eligible to plea no contest once every five years on a failure to maintain insurance citation. This will prevent a license suspension, however, if you get a second no insurance citation in that five year period, you will face a mandatory 90 day license suspension and you will not eligible to plead no contest (nolo contendere).
More importantly, it is likely your car will be impounded if you are pulled over for not having insurance on the vehicle. Some officers may allow you to purchase insurance on the side of the road to prevent impounding but that is not always the case. If you have not had valid insurance on your vehicle for a period of 10 days or more, you will be fined $25 which must be paid. If you do not have insurance for a period of 30 days and/or did not pay the $25 10 day lapse fee, your registration will be suspended. Suspended registration is an additional violation of Georgia Code section 40-6-15. A suspended registration conviction carries with it a separate drivers license suspension of 120 days on a first offense. You are eligible for a limited driving permit for this suspension, but you will be restricted in your ability to drive during that 120 days. Suspended registration convictions also contribute to habitual violator status.
