Traffic Citations, DUI, Theft by Shoplifting, and Misdemeanor Marijuana in the Acworth Municipal Court

The Acworth Municipal Court is located at 4408 Acworth Industrial Drive, Acworth Georgia 30101 and handles traffic citations and select misdemeanor charges that occur within the city limits of Acworth Georgia. Acworth has its own police department, the Acworth Police Department which patrol the streets and communities within the city limits of Acworth. The Acworth Police Department regularly issues traffic citations which are handled in the Acworth Municipal Court. Common Acworth traffic citations include Speeding, car accident citations such as following too closely, failure to yield, improper lane change, failure to maintain lane, failure to obey traffic control device, and hit and run, document charged such as expired tag, no insurance, and driving without a license or driving on a suspended license. The Acworth Municipal court also handles select misdemeanor charges including Acworth DUI arrests, Theft by Shoplifting, Possession of Marijuana less than One Ounce, and Minor in Possession of Alcohol. Finally, the Acworth Municipal Court handles city ordinance violations for the city of Acworth.

The Acworth Municipal Court is open Monday through Friday 8am to 5pm in order to pay traffic citations, confirm court dates and request information about your court case. Some traffic citations can be paid online, but a lot of the more serious traffic citations are “must appear” offenses, meaning they cannot be paid in advance. The Chief Judge of the Acworth Municipal Court is H. Luke Mayes IV and the city solicitor that handles prosecution for Acworth is Randall Bentley. If you pay your ticket in advance or just appear and say you want to plead guilty, you will be pleading guilty to the charge as originally written and pay a pre-set fine determined by the court. Everyone has the right to pre-try their case with the solicitor by requesting a pre-trial. Doing that may allow you to get charges amended, dismissed, fines reduced, or other outcomes that may be to your benefit. You also have a right to a bench trial in the Acworth Municipal Court in all cases and a jury trial in all charges that have the risk of potential jail time which is most traffic citations and all non-traffic misdemeanor offenses. Jury trials are not held in the Acworth Municipal Court, but are held in the Cobb County State Court located at 12 E Park Square, Marietta Georgia 30090, right off the Marietta Square.
